Halle Berry Custody Battle Turns Ugly

It's turning into an epic battle between Halle Berry and Gabriel Aubry for custody of their daughter as accusations and name-calling begin to surface. INSIDE EDITION has the scoop.

The gloves are off in Halle Berry's custody war with male model Gabriel Aubry. The Oscar® winner even claims he called her the "N"-word.

People magazine's West Coast Editor, Mike Fleeman told INSIDE EDITION, "A source close to Halle tells us that Gabriel Aubry has a dark side, that has an anger problem, that he has lashed out at her, and he's even used a racial slur."

The battle for Berry's baby is on the cover of the new People magazine, out Friday. And Aubry is reportedly threatening to reveal e-mails and audio of Berry losing her temper.

Fleeman said, "A source close to Aubry tells People that it's Halle who has the attitude problem."

It's shaping up to be an epic case of he said/she said. In a statement, Berry says that she has "serious concerns for her daughter's well-being while in the care of her father for any extended period of time."

Today, Aubry is fighting back, accusing Berry of trying to "falsely malign him publicly" and insists that he's a "caring father" to 2 1/2-year-old Nahla.

Among Aubry's other claims, that Berry has a total lack of respect for him and refers to him as "just a model."

Berry was also said to have flipped out when her ex recently dated Kim Kardashian.

"She didn't want a reality star in her social circle. She didn't want this mere reality star hanging around with Gabriel," said Fleeman.

And Aubry reportedly despises Berry's new man, actor Olivier Martinez, and "is not happy with some things that have taken place—some very adult activities—in the presence of Nahla."

Now Aubry's ex, a Los Angeles businesswoman named Paige Bogart, is coming forward, saying that she warned Berry that Gabriel's "entire motivation has always been money, but I guess she didn't want to believe it."

The male model has filed court papers seeking joint custody.

Meantime actress Katherine Heigl has been tapped to replace Berry in the upcoming film New Year's Eve. Berry dropped out to deal with her legal issues.
