The call girl at the center of the Eliot Spitzer sex scandal is involved in a new controversy today.
The scandal is over graphic videotapes of call girl Ashley Dupre shot at a Spring Break party for Girls Gone Wild in 2003.
The tape may be worth a fortune to Girls Gone Wild founder Joe Francis, who planned to release the video on his website.
The problem is that Ashley says she was only 17-years-old when the explicit video was made.
Ashley's attorney e-mailed Girls Gone Wild, saying, "It would be outrageous at the very least to play the video of an underage female on the internet."
After receiving the complaint, Francis said he was delaying the release the most graphic footage and would "investigate" the claim that she was underage.
Lisa Bloom, television legal expert and host of True TV's In Session told INSIDE EDITION, "She has to actually be 18 at the time of the shooting of the video if there is a sex act on that video or Joe Francis cannot show it. If he does show it, he's going right back to jail."
Francis was recently released from prison in Nevada. He pled not guilty to tax fraud. This is not the first time he has been accused of allegedly using under age teenagers videos.
The same year Ashley Dupre made this video, teenaged beauty queen Jamie Capdeboscq made an appearance in a Girls Gone Wild video hosted by rapper Snoop Dogg, and told INSIDE EDITION all about it.
"He [knew I was 17], I showed him my driver's license," said Capdeboscq.
She sued Francis, claiming he knew she was underage. The case was settled out of court for an undisclosed sum.
