Hear the Disturbing 911 Call From Man Police Say Killed His Brother Over a Cheeseburger

Benjamin Middendorf, 25, fatally shot his brother during a heated argument over a cheeseburger, police say.

A Florida man is behind bars after police say he fatally shot his brother in a heated argument over a cheeseburger.

Disturbing 911 audio released by the St. Cloud Police Department reveals the chaotic few moments after police say Benjamin Middendorf, 25, murdered his older brother Nicholas while their mother stood by in horror just two days before Mother's Day.

"We were in a fight and I grabbed a gun and I shot him. Oh my god," said a panicked male 911 caller police identified as Benjamin Middendorf. "He's dead!"

Police say Nicholas Middendorf was shot in the chest with a 9mm handgun following a verbal dispute.

While the 911 caller said he was putting pressure on the wound, a woman later identified as their mother came on the line.

“My son, just shot my son," the woman said. She could later be heard saying “I hope you go to jail" to her surviving son.

In a statement to reporters, St. Cloud Police Department spokesperson Denise Roberts revealed the argument started over dinner.

“This is an impulsive incident that happened. Maybe anger, rage. But it was definitely over a verbal dispute that sadly, it was over a cheeseburger," Roberts said.

According to an arrest affidavit, Middendorf's mother and the victim had been out drinking with friends to celebrate Cinco de Mayo prior to the incident. 

Benjamin Middendorf told police he does not drink.

He was arrested on charges of premeditated first-degree murder and taken to the Osceola County Jail where he's being held without bond. As of Monday morning, Middendorf had not yet entered a plea.
