82-Year-Old Woman Sues Red Lobster After Getting Drunk at Bar, Breaking Hip and Arm

An elderly woman in Texas is suing Red Lobster, claiming the restaurant overserved her alcohol to the point where she got so drunk that she fell, breaking her hip and arm.

Marlene Spencer, 82, walked from Brookdale Senior Living at Clear Lake to the nearby Red Lobster to go to the bar on or around March 27, according to a lawsuit filed in Harris County Monday.

The 113-pound woman was allegedly sold numerous alcoholic beverages, becoming “more than obviously intoxicated,” the suit said.

Yet the bar allegedly continued to serve Spencer until her blood alcohol level was .31, nearly four times the legal limit.

“Ms. Spencer did not even make it out of the parking lot of Red Lobster,” the lawsuit said.

According to the suit, the octogenarian fell, breaking her right hip and right arm and hitting her head on the pavement.

She was taken by ambulance to Clear Lake Regional Hospital to be treated for her injuries.

The senior living facility was made aware of the incident a few hours later, when a manager from Red Lobster attempted to leave a message to let a companion of Spencer’s know she had been taken to the hospital, the lawsuit said.

Spencer had to undergo a total hip replacement, detoxification and needed to have her head examined. She spent six days in intensive care and then needed to attend rehabilitation for an extended period of time, the lawsuit said.

The incident was not the first time Spencer or other residents of the senior living center were overserved at the sea food restaurant, according to the suit.

In the months leading up to the incident, Spencer’s daughter said she had multiple conversations with the Red Lobster bar manager about serving her mother too many drinks.

“This was an ongoing problem that Ms. Spencer’s daughter tried to quell, but to no avail,” the lawsuit said. “This has been a recurring problem with multiple Brookdale residents.”

Spencer is suing for past and future conscious pain and suffering, mental anguish and medical expenses.

Messages left for Red Lobster by InsideEdition.com were not immediately returned Wednesday.
