Florida Teen Overheard Allegedly Raping Girl After Leaving Game Microphone on While Playing 'GTA'

A Florida teen was arrested after a virtual witness came forward to say that he had heard him allegedly rape a girl.
Daniel Enrique Fabian, 18, has been charged with lewd and lascivious sexual battery in connection with an assault in late June.
On June 28, Fabian allegedly had a 15-year-old girl over at his house in New Port Richey while he played Grand Theft Auto on his PlayStation, according to the Pasco County Sheriff’s Office.
He told a 16-year-old witness, whom he was playing online with, that he was going to have sex with the girl, court documents state.
The witness told police that Fabian left his microphone on during the alleged assault so he was able to hear what was happening.
“The witness then heard the victim say, ‘No,’” according to court documents. “After 15 minutes, the defendant resumed playing the video game with the witness.”
The alleged victim also told police she said "no" four times, police said.
Fabian was arrested on Nov. 21 after a DNA test taken from the 15-year-old’s rape examination linked him to the alleged assault. He is being held without bail and has not yet entered a plea.
