Virgil Bates III, 40, told a Toledo judge that he went home in June one day to see if his wife was lying about breaking off her affair.
When he entered the bedroom, he says he found them in bed together. Bates says he put his wife’s lover, Matthew Tipton, 44, in a headlock and told the judge that the man bit his arm according to The Toledo Blade.
“I was able to get [the victim] in a headlock,” Bates told Lucas County Common Pleas Judge Ruth Ann Franks. “He proceeded to clamp down and bite my forearm. I proceeded to panic, and I wound up biting his ear, and a piece of his ear came off."
The Judge asked Bates: “Why didn’t you just walk out when you saw him then, run out of the house?”
“To me, he was in my bed,” Bates replied.
An assistant prosecutor says the top part of the victim’s ear could not be fixed and the medical treatment was “extremely painful.”
